FULTON COUNTY SCHOOLS' APPEAL ASSIGNED HEARING OFFICER

Fulton County Schools Superintendent Aaron Collins on Friday, when contacted by The Current, reported, “The Commissioner of Education has requested that the state's Administrative Hearings Branch, Office of the Attorney General, assign a Hearing Officer to hear the case. A hearing officer has been assigned. The case is Administrative Action No. 19-BOE-0018.”

Collins was referring to Fulton County Schools’ appeal filed Jan. 31 with the Kentucky Department of Education, Dr. Wayne Lewis, Commissioner of Education concerning nonresident contracts between Fulton County Schools and Fulton Independent Schools. According to Collins, the Order was served Feb. 6, and he was notified Feb. 8 that the legal office of the Department of Education will contact the Fulton County School System regarding the next step in terms of the Appeals process.

The appeal provided background information to the Commissioner, including the Fulton County School Board’s review of a proposed nonresident agreement for the 2019-2020 school year on Dec. 13, 2018, received from the Fulton Independent School District, which proposed a nonresident agreement for a specific number of 10 students and then, a one to one agreement, dated Jan. 31, 2019.

Fulton Independent Schools rejected a request from Fulton County Schools for an “Any and All” student policy.
